H1B Visa
The H-1B Visa is a non-immigrant visa that allows U.S. companies to employ foreign workers in specialty occupations. It is one of the most sought-after visas for skilled professionals looking to work in the United States, particularly in fields such as technology, engineering, medicine, finance, and education.
Key Features of the H-1B Visa
By partnering with Glocal, you benefit from our extensive knowledge and experience in U.S. immigration law, ensuring a smooth and efficient H-1B Visa process. Whether you are an employer looking to hire skilled foreign workers or a professional seeking opportunities in the U.S., we are here to help you achieve your goals.
Specialty Occupation Requirement
- The H-1B Visa is designed for positions that require specialized knowledge and a bachelor’s degree or higher in a specific field. Common fields include IT, engineering, mathematics, science, and healthcare.
- The job must meet certain criteria to qualify as a specialty occupation, such as requiring a degree that is common to the industry or being so complex that it can only be performed by a degree holder.
Employer Sponsorship
- An H-1B Visa applicant must have a U.S. employer willing to sponsor them. The employer is responsible for filing a petition with U.S. Citizenship and Immigration Services (USCIS) on behalf of the employee.
- The employer must demonstrate that they will pay the prevailing wage for the position and that hiring the foreign worker will not adversely affect the working conditions of U.S. workers.
Duration of Stay
- The H-1B Visa is initially granted for up to three years, with the possibility of extension up to a maximum of six years.
- Under certain circumstances, extensions beyond six years may be available, particularly for those with pending green card applications.
Application Process
- The H-1B application process begins with the employer filing a Labor Condition Application (LCA) with the Department of Labor, attesting to the wage and working conditions.
- After obtaining LCA approval, the employer files Form I-129 with USCIS, including all supporting documentation and filing fees.
- Upon approval, the applicant may apply for an H-1B Visa at a U.S. consulate if they are outside the U.S., or change their status if already in the U.S.
Cap and Lottery System
- The H-1B Visa program is subject to an annual cap of 85,000 visas, which includes 65,000 regular visas and an additional 20,000 for applicants with a U.S. master’s degree or higher.
- Due to high demand, a lottery system is often used to select petitions, making the process competitive.
Dependents
- H-1B Visa holders can bring their spouse and unmarried children under 21 to the U.S. under the H-4 Visa category.
- H-4 Visa holders may be eligible to apply for work authorization, allowing them to work in the U.S. under certain conditions.
Dual Intent
- The H-1B Visa allows for dual intent, meaning visa holders can apply for a green card while maintaining their H-1B status.
- This feature makes the H-1B Visa an attractive option for foreign professionals seeking long-term residency in the U.S.
